Fairfax Legal has successfully defended the sitting member for Usino-Bundi in Madang Province, the Hon. Jimmy Uguro, against an election petition filed by the former member Mr. Anton Francis Yagama in the Supreme Court.
Yagama had commenced proceedings against Uguro MP in the National Court in October 2017 in the aftermath of the national elections last year. After a series of claims by Yagama were successfully defended against on procedural and substantive grounds, Yagama appealed the decisions of the lower court to the Supreme Court.
On 29 June 2018, the Supreme Court delivered its decision with respect to proceedings filed by Yagama against Uguro MP and the Electoral Commission of Papua New Guinea. Finding in favour of Uguro MP, the Supreme Court upheld the National Court’s decisions on the basis that Yagama had failed to follow court procedure in filing his applications and on the grounds that he lacked sufficient evidence to prove his case.
The Supreme Court also ordered costs against Yagama.
